Update on Title IX in Public Schools and Duties of Coordinators: Where Are We Now?




With the new administration came changes to District's Title IX obligations to address sex discrimination. Biden-era regulations were rescinded and replaced by the previous 2020 version of the regulations. Thus, this session will address schools' obligations under the 2020 regulations, including enhanced due process for students accused of sex harassment, splitting of investigative and fact-finding duties in complaints, questions posed to complaining students from representatives of accused students, and more. Also, the session will address current areas of focus in OCR Title IX investigations, particularly in the area of gender identity issues. In addition, the session will address the key functions and duties of districts' Title IX coordinators, from complaints, supportive measures, and monitoring of allegations, to athletics issues, policy maintenance, and required notices. Recent caselaw examples will illustrate the legal issues presented and ample Q&A opportunities will be provided throughout presentation.
