Student Discipline Under IDEA and Chapter 37 of the Texas Education Code
VIRTUAL PD - AM Session




This session will review the rules of disciplinary removals of students with disabilities under the IDEA, including limitations on short term removals, patterns of removals, manifestation determination requirement for long term removals, the exception of smart ISS and other doctrines under special education law. In addition, the session will review the application of Chapter 37 of the Education Code including teacher removals, suspensions, DAEP offenses, expellable offenses, and common misconceptions about interpretations of those provisions. Throughout the presentation, caselaw examples will demostrate the legal concepts and practical tips will be presented to assist campuses in meeting their obligations under the law while enforcing their local codes of conduct.
