The ARDC process is the primary means by which the IDEA ensures meaningful parental participation in IEP development.This session will address selected legal issues for school ARDC members, including the roles of members in manifestation review (MDR) meetings, proper data to collect and consider in MDRs, correct analysis to answer the MDR questions, stating a cogent and concise rationale for MDR answers and case examples illustrating common MDR issues. In addition, the session will address general ARDC process requirements, including ARDC membership, the role of regular ed teachers, scheduling of ARDC meetings, meetings without parents, evaluation review, the 10-day recess procedure preventing predetermination in ARDC meetings, and strategies to handle disagreements and dispute situations, among others.
